When making a booking, the applicant / hirer will be deemed to have read and understood the following Terms & Conditions:
Please note that all control of CROSPLE COTTAGE rests with us (the owners) or as delegated in our absence to the Caretaker.
GENERAL
We do ask, please, that you look after the house, its contents and the garden whilst they are in your care and you leave the house in the same tidy and clean condition at the end of the rental as at the beginning. We must be notified immediately of any breakages or damage. You are legally bound to reimburse us for any replacement, repair or cleaning costs on demand.
DEPOSIT
A deposit of 20% of the full rental is required to confirm your booking. The balance of the rent will be due six weeks before commencement of holiday. See Terms and Conditions paragraphs 7 and 8.
Cheques payable to R.A & J.H. Campbell-Gibson and addressed to Glenfearnach, Melfort, Kilmelford, Argyll, PA34 4XD. Bank transfer, Paypaland credit card payments are also accepted.
BOOKINGS
1. CROSPLE COTTAGE is let under Section 12(2) and Paragraph 8, Schedule 4 of the Housing (Scotland) Act 1988. This means that it is to be used for holiday lets only and may not be sub-let. The maximum number of visitors permitted is two.
2. CROSPLE COTTAGE may be booked for periods of one week to four weeks. Shorter breaks of a minimum of 4 nights throughout the year are also permitted.
3. A letting week runs from 4.00pm on the day of arrival until 10am seven days later unless otherwise stated
4. Provisional bookings can be held for 7 days and will only be confirmed after the receipt of the booking form and the deposit.
5. Bookings, for the weeks requested, are subject to the accommodation still being available when your booking form and deposit are received.
6. The booking form and deposit from you, the applicant / hirer, together with our acceptance of the deposit, will constitute a contract. Bookings by persons under 18 years of age cannot be accepted. The number of people occupying the property is limited to that stated at the time of booking, unless by prior consent with the owner.
7. We do not charge a security deposit in addition to the rent. We choose to trust our customers to respect the property and its content and to leave it in the same condition in which they found it when they arrived.
8. A deposit of 20% of the value of the full rental is payable to confirm a provisional booking. The deposit is part of the full rental of your holiday accommodation and is non refundable in the event of cancellation. If a booking is made within six weeks of the start date of your holiday the full rental is payable.
9. The balance of the rental is to be paid in full not less than six weeks before the starting date. The owners are not obliged to issue any reminders and do not normally do so. Failure to make full payment by the due date will be treated as a cancellation. If we do not receive the same by this date, we will consider the reservation to be cancelled and the deposit will be forfeited.
10. The accommodation charges are as listed on the website. Entry time: 4.00pm day of arrival. Departure time: 10am day of departure.
CANCELLATION
11. Notice to cancel a booking is to be in writing by email. Provided the notice of cancellation is received not less than six weeks before the start of your holiday, only the deposit will be forfeited.
12. If however notice to cancel has not been received by the time specified and we are, in addition, unable to re-let the accommodation for the same period at the same rate, then you will be liable to pay the total cost of the booking. However, every endeavour will be made to re-let on the hirer's behalf, and if successful the balance will be refunded.
CANCELLATION INSURANCE
13. We strongly recommend that you take out insurance to protect yourself against financial loss in case you are obliged to cancel your holiday because a member of your party becomes ill. Two insurance companies, which specialise in this cover, are www.schofields.ltd.uk (UK residents only) and www.jlmorris.co.uk/self-catering-insurance.
OCCUPANCY
14. You, the hirer, are to stay personally at CROSPLE COTTAGE throughout the holiday and are solely responsible for the whole party. Assignees and sub-tenants are prohibited. The number of persons, using CROSPLE COTTAGE is not to exceed TWO unless agreed in advance and in writing by us. We are entitled to refuse accommodation to any person who, in our opinion, is not suitable to take charge, or whose behaviour is deemed unacceptable. We are entitled to terminate the hire if these conditions are broken.
ELECTRIC VEHICLES
14b. The charging of electric vehicles by means of an extension cable plugged into the house supply is NOT permitted under any circumstances. We reserve the right to refuse entry to the entire party, or to terminate the stay, without refund, if this condition is not complied with. The closest EV charging points are at Tesco, Oban (21km)
PETS
15. We do not allow pets in the house at any time.
VISITOR'S LIABILITY
16. When you submit your deposit, you are guaranteeing to us that you have the authority to sign on behalf of all the persons, who will use CROSPLE COTTAGE during the holiday booked.
17. From the time of arrival, you and any other person, accompanying you, take full responsibility for any loss, injury or damage suffered by you or those accompanying you while on CROSPLE COTTAGE ground, except where such loss, injury or damage is directly due to the acts or omissions by ourselves or those employed by us.
18. You also agree to keep CROSPLE COTTAGE and all furniture, fixtures, fittings and effects in or on the accommodation in the same state of repair as at the start of the let, and will make good any damage, breakage or loss occurring during the let. The property and all fitments, furniture, utensils, equipment, etc. are to be left in a clean and tidy condition at the end of the let. You agree to indemnify us against all loss and/or damage arising directly or indirectly to the accommodation and its contents from any act or omission by yourself or any person accompanying you. You undertake to ensure that CROSPLE COTTAGE is securely locked, if left unoccupied during your
stay.
19. We reserve the right to refuse entry to the entire party, or to terminate the stay, without refund, if any of these conditions are not complied with. We also reserve the right to refuse a booking from a guest who has previously stayed and left the house in an a disagreeable state on their departure.
ACCESS
20. Right of entry is reserved at all reasonable times during any occupancy for the purpose of inspection or to carry out necessary repairs and maintenance.
LIABILITY
21. We will not be liable for any accident, damage, loss, injury, expense or inconvenience whether to person or property which the hirer or any other person may suffer or incur. If for any reason beyond our control (e.g. fire, storm damage, illness etc) CROSPLE COTTAGE is not available on the date booked or if it becomes subject of sale for any reason, we will refund in full all monies paid by you, the hirer. We shall not be liable for any loss, expense or inconvenience resulting from such unavailability and you, the hirer, shall have no claim against us.
22. Every effort has been made to ensure that you have an enjoyable and memorable holiday. If, however, you have cause for complaint, we are anxious that remedial action is taken as quickly as possible. It is essential you contact us so that any remedial action can be speedily implemented.
